# Terms of Service

## 1. Acceptance of Terms

By installing or using Piligrim ("the Service"), you ("the User") agree to these Terms of Service ("Terms"). If you do not agree, do not install Piligrim and remove it if already installed.

The Service is operated by **Madfish Solutions Inc.** ("Operator"), a company incorporated in the **British Virgin Islands**, BVI Company Number **2069355**, registered office Intershore Chambers, P.O. Box 4342, Road Town, Tortola, VG1110, British Virgin Islands.

These Terms incorporate by reference our **[Privacy Policy](./privacy.md)**.

## 2. Description of the Service

Piligrim is a **free** browser extension that:
- Routes a portion of your web traffic through a VPN/proxy network operated by Webshare.io.
- Shows display ads on third-party websites you visit, in slots where advertising would otherwise be shown.
- Maintains a balance of "free quota" (MB of VPN traffic) and "Steps" (additional MB earned by viewing replaced ads).

The Service is funded by revenue from those ads. **No payment is required from you to use the Service.**

## 3. No account, no personal information

Piligrim does not require an email, password, name, or any personal information. You are identified by an **anonymous install ID** generated on your device.

You are responsible for keeping your install secure (your install ID and ECDSA keys are stored in your browser's local extension storage; if your device is compromised, an attacker could spend your Steps balance).

## 4. Free use, no warranty of availability

The Service is provided **free of charge** and **"as is"**. We do not guarantee:
- Continuous availability (we may experience outages, maintenance, or discontinuation)
- Specific connection speeds, latency, or stability
- Successful ad replacement on every site (some sites use ad networks we do not yet support)
- Privacy or anonymity sufficient for **high-stakes situations** including but not limited to: journalism in authoritarian jurisdictions, evading state surveillance, whistleblowing, accessing services that prohibit VPN use

**If you require privacy-critical protection, use a paid commercial VPN designed for that purpose.** Piligrim is a casual-use product.

## 5. Acceptable use

You agree NOT to use Piligrim to:

- (a) Conduct illegal activity under the laws of your jurisdiction or the jurisdiction where our servers are located
- (b) Fake ad impressions, run bots, scripts, or browser automation against the Service to harvest free Steps or VPN quota
- (c) Reverse-engineer, decompile, or modify the extension to bypass our anti-fraud, viewability, or rate-limit guardrails
- (d) Operate multi-installation farms (multiple installs on the same device) to multiply free quota
- (e) Use Piligrim to access services whose Terms of Service prohibit VPN or proxy use, in a way that violates those Terms
- (f) Use Piligrim to harm minors, distribute malware, send spam, or commit fraud against any third party
- (g) Resell access to Piligrim or operate Piligrim as a hosted service for third parties

We reserve the right to **suspend or terminate** any install ID found violating these rules, with or without notice. Detection methods include impression-fraud signals, abnormal usage patterns, and reports from advertising partners.

## 6. The ads we show

Piligrim shows display ads on third-party websites you visit. The ads are:
- Selected by us from a pool of advertisers we contract with
- Served from our own infrastructure
- Sandboxed in iframes; they cannot read or modify the surrounding page

You acknowledge that:
- The websites you visit may have their own Terms of Service governing ad replacement; you are responsible for compliance with those Terms.
- We are **not the publisher** of those websites and assume no responsibility for their content.
- If you see an offensive, illegal, or fraudulent ad through Piligrim, please report it: **info@madfish.solutions**. We aim to remove confirmed violations within 48 hours.

## 7. Third-party services

Piligrim's operation depends on **Webshare.io** (proxy network) and **ipapi.co** (geolocation). Your traffic and IP are processed by these third parties as described in our Privacy Policy. We do not control their services and are not liable for their actions or failures.

## 8. Limitation of liability

**Piligrim is provided free of charge.** To the **maximum extent permitted by applicable law**, the total aggregate liability of the Operator, its officers, employees, and agents, arising from your use of the Service, is **capped at USD 0**.

We are **not liable** for:
- Lost data, lost revenue, business interruption, loss of goodwill
- Damages from the content of third-party websites you visit via Piligrim
- Damages from the content of ads shown via Piligrim
- Damages from regulatory or enforcement actions in your jurisdiction
- Damages from Webshare.io, ipapi.co, or any other third-party processor
- Damages from accidental exposure of your real IP if our proxy fails (use a paid VPN if this matters)

This limitation applies regardless of the legal theory: contract, tort, statute, or otherwise.

**EEA / UK consumers**: nothing in these Terms excludes liability for death, personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

## 9. Indemnification

You agree to indemnify, defend, and hold harmless the Operator from and against any third-party claim arising from:
- Your violation of these Terms
- Your violation of applicable law while using Piligrim
- Your misuse of the Service to harm a third party

## 10. Intellectual property

The name "Piligrim", our logos, brand elements, and the source code of the closed-source portions of the extension are the exclusive property of the Operator. The extension is licensed to you on a **non-exclusive, non-transferable, revocable** basis for personal use only.

You may **not**:
- Use our brand or logos for commercial purposes without written permission
- Distribute modified versions of the extension
- Imply endorsement or partnership with the Operator

## 11. Suspension and termination

You may stop using Piligrim at any time by **uninstalling** the extension. All data tied to your install ID is retained per our Privacy Policy until you request deletion or until automatic retention expiry.

We may terminate or suspend your access:
- Immediately, without notice, for violations of §5 (Acceptable use) or §10 (IP)
- With reasonable notice, for any other reason, including discontinuation of the Service
- Immediately, to comply with legal obligations

Upon termination, your balance of Steps and free quota is **forfeited without compensation** (since the Service is free).

## 12. Modifications to the Service or Terms

We may modify the Service (features, supported sites, ad partners) at our discretion.

We may update these Terms. **Material changes** (changes to liability limits, acceptable use, governing law) take effect 30 days after publication and require renewed in-extension acceptance. Non-material changes take effect on the new "Effective date".

## 13. Governing law and jurisdiction

These Terms are governed by the **laws of the British Virgin Islands**, without regard to conflict-of-laws rules.

Disputes will be resolved as follows:
- **First**: informal good-faith negotiation. Email **info@madfish.solutions**.
- **If unresolved**: in the **courts of the British Virgin Islands sitting at Road Town, Tortola**, to whose exclusive jurisdiction the parties submit (subject to the EEA / UK consumer carve-out below).
- **EEA / UK consumers**: nothing in these Terms deprives you of the right to bring proceedings in your country of residence as guaranteed by EU Regulation 1215/2012 (Brussels I recast) or equivalent UK law.

## 14. Severability, entire agreement, no waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.

These Terms, together with our Privacy Policy, constitute the **entire agreement** between you and the Operator regarding Piligrim. No prior communications, marketing materials, or representations form part of the agreement unless explicitly incorporated here.

Failure to enforce a right is not a waiver of that right.
